Picosoft Solutions provides IT consulting, software development, cloud and AI-related services, and software products for individual and corporate users. The Site presents our company, services, portfolio, and products. Marketing content on the Site does not, by itself, constitute a binding offer. Specific commercial terms for paid or enterprise use may be set out in a separate order form or agreement.

You may use the Site and Services for lawful purposes only. You agree not to misuse them, including by attempting unauthorised access, introducing malware, interfering with other users, scraping in a way that impairs our systems, or violating applicable laws in Malaysia or your jurisdiction.

When using messaging, email, social publishing, support, CRM, or automation features within our Services, you are responsible for obtaining any required consents and complying with applicable platform rules, anti-spam laws, and regulations that apply to you. You must not use our Services to send unlawful, deceptive, harassing, or unsolicited communications, or for other prohibited activity.

We may suspend or restrict access where we reasonably believe these Terms have been breached or where required for security, abuse prevention, or legal reasons.

You are responsible for keeping your account credentials secure and for activity under your account. You retain ownership of content you submit through the Services, but grant Picosoft a limited licence to host, process, and transmit that content solely to operate and improve the Services you use.

You represent that you have the right to provide any data, contact lists, messages, posts, or other content you upload or send through our products.

The Site, Services, and their content (including text, graphics, logos, layout, and software) are owned by Picosoft or our licensors and are protected by copyright and other intellectual property laws. You may view and print reasonable portions of the Site for personal, non-commercial use. You may not copy, modify, distribute, reverse engineer, or create derivative works without our prior written consent, except where allowed by law or an applicable licence.

The Site and Services may link to or integrate with third-party websites, APIs, or platforms. We are not responsible for third-party content, availability, or practices. Your use of third-party services is at your own risk and subject to their terms and policies.

Blog posts, case studies, product descriptions, and marketing material are provided for general information. They are not professional, legal, financial, or investment advice. Technical approaches and delivery timelines for your organisation should be confirmed in a separate written agreement or statement of work where appropriate.

The Site and Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site or Services will be uninterrupted, error-free, or free of harmful components, or that any automated or integrated feature will meet your business or financial outcomes.

To the fullest extent permitted by applicable law, Picosoft and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of or inability to use the Site or Services.

Our total liability for any claim arising out of or relating to the Site, Services, or these Terms shall not exceed the greater of (a) the amount you paid us for the relevant Service in the twelve (12) months before the claim, or (b) MYR 100, if you paid nothing.

You agree to indemnify and hold harmless Picosoft from claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Site or Services, content you submit or send through our products, or violation of these Terms or applicable law, to the extent permitted by law.

We may update these Terms from time to time. The “Last updated” date at the top will change when we do. Continued use of the Site or Services after changes constitutes acceptance of the revised Terms. If changes are material, we will use reasonable efforts to highlight them on the Site or within the affected Service.

These Terms are governed by the laws of Malaysia. Courts in Malaysia shall have non-exclusive jurisdiction over disputes arising from or relating to these Terms, the Site, or the Services, subject to any mandatory provisions of law.
