These Terms of Use (“Terms”) govern your access to and use of the website operated by Picosoft Solutions (“Picosoft”, “we”, “us”) at picosoft.com.my and related pages (the “Site”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. Who we are

Picosoft Solutions provides IT consulting, software development, cloud and AI-related services. The Site is intended to present our company, services, portfolio, blog content, and products such as Jibby. It does not, by itself, constitute a binding offer to provide services.

2. Use of the Site

You may browse the Site for lawful purposes only. You agree not to misuse the Site, including by attempting to gain unauthorised access, introducing malware, scraping the Site in a way that impairs our systems, or using the Site to violate applicable laws in Malaysia or your jurisdiction.

We may suspend or restrict access where we reasonably believe these Terms have been breached or where required for security or legal reasons.

3. Intellectual property

Content on the Site (including text, graphics, logos, layout, and software) is owned by Picosoft or our licensors and is protected by copyright and other intellectual property laws. You may view and print reasonable portions for personal, non-commercial use. You may not copy, modify, distribute, or create derivative works without our prior written consent, except where allowed by law.

The Site may link to third-party websites or services (for example, social profiles or partner tools). We are not responsible for third-party content or practices. Your use of third-party sites is at your own risk and subject to their terms.

5. Informational content

Blog posts, case studies, and marketing descriptions are provided for general information. They are not professional, legal, or financial advice. Technical approaches and timelines for your organisation should be confirmed in a separate written agreement or statement of work.

6. Disclaimer of warranties

The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

7. Limitation of liability

To the fullest extent permitted by applicable law, Picosoft and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of or inability to use the Site.

Our total liability for any claim arising out of or relating to the Site or these Terms shall not exceed the greater of (a) the amount you paid us specifically for access to the Site (if any) in the twelve (12) months before the claim, or (b) MYR 100, if you paid nothing for Site access.

8. Indemnity

You agree to indemnify and hold harmless Picosoft from claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Site or violation of these Terms, to the extent permitted by law.

9. Changes

We may update these Terms from time to time. The “Last updated” date at the top will change when we do. Continued use of the Site after changes constitutes acceptance of the revised Terms. If changes are material, we will use reasonable efforts to highlight them on the Site.

10. Governing law

These Terms are governed by the laws of Malaysia. Courts in Malaysia shall have non-exclusive jurisdiction over disputes arising from or relating to these Terms or the Site, subject to any mandatory provisions of law.
