Terms of Service

1. Introduction

Welcome to PicoMessage (“the App”), a Facebook App provided by Picosoft Solutions Sdn Bhd (“we,” “our,” or “us”).

The App integrates with the WhatsApp Business Cloud API to help businesses manage customer conversations, automate replies, and improve engagement. By using the App, you agree to these Terms of Service (“Terms”). If you do not agree, please do not use the App.

2. Eligibility

To use the App, you must:

• Have a valid Facebook/Meta Business account linked to a WhatsApp Business account.

• Be authorized to access and manage your business’s WhatsApp messages.

• Comply with all applicable laws, Meta’s Terms of Service, and WhatsApp Business policies.

3. Use of the App

You agree to use the App only for lawful business purposes and in compliance with Meta and WhatsApp Business Platform policies. Prohibited uses include (but are not limited to):

• Sending spam or unsolicited messages

• Misusing customer data or violating user privacy

• Using the App for fraudulent, illegal, or harmful activities

We reserve the right to suspend or terminate access if misuse is detected.

4. Data Handling

• We only access the WhatsApp Business and Facebook data necessary to provide the App’s services.

• Data is handled in accordance with our Privacy Policy.

• You retain ownership of your business data; we only process it to provide services.

5. Service Availability

We strive to keep the App available at all times, but we do not guarantee uninterrupted access. The App depends on third-party services (such as Meta/WhatsApp APIs), and disruptions or changes on their side may affect functionality.

6. Fees

The App may be provided free or with a subscription/usage fee, depending on your agreement with us. Any fees will be communicated separately.

7. Limitation of Liability

To the fullest extent permitted by law:

• We are not liable for any indirect, incidental, or consequential damages resulting from the use or inability to use the App.

• We are not responsible for losses caused by outages or changes to Meta/WhatsApp services.

8. Termination

You may stop using the App at any time by removing it from your Facebook Business account.
We may suspend or terminate access if you violate these Terms or applicable laws.

9. Changes to These Terms

We may update these Terms from time to time. Updates will be posted here with a new effective date. Continued use of the App after changes means you accept the updated Terms.

10. Governing Law

These Terms are governed by the laws of Malaysia, without regard to conflict of law principles.
